Terms of Service
The terms governing your use of Position5 products and services.
1. Acceptance of terms
By accessing or using any Position5 website, product, or service ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
2. Description of services
Position5 provides digital software products, including but not limited to WordPress plugins, software license keys, and related services. All products are delivered electronically. There are no physical goods or shipments.
3. Accounts & purchases
When you make a purchase, you agree to provide accurate and complete billing information. All payments are processed securely through Stripe. By completing a purchase, you authorize us to charge the provided payment method for the total amount of your order.
You are responsible for maintaining the confidentiality of your account credentials and license keys. You are responsible for all activity that occurs under your account.
4. License terms
Upon purchase, you are granted a non-exclusive, non-transferable license to use the purchased software product in accordance with the specific license terms for that product. License keys are tied to the plan and activation limits specified at the time of purchase.
You may not redistribute, resell, sublicense, or share your license key with third parties. Violation of license terms may result in license revocation without refund.
5. Subscriptions & billing
Some products are offered on a subscription basis with recurring billing. By subscribing, you authorize recurring charges at the interval and price specified at checkout. Subscription prices may change with notice before your next billing cycle.
You may cancel your subscription at any time through your account dashboard or by contacting cr.carlosandres@gmail.com. Cancellation takes effect at the end of the current billing period.
6. Refunds
Refund eligibility is governed by our Refund & Return Policy. In summary: we offer a 14-day return window for license keys that have not been activated or used. Activated licenses are not eligible for refunds.
7. Intellectual property
All Position5 products, content, trademarks, and related materials are the intellectual property of Position5. Your license grants you the right to use the software but it does not transfer ownership of any intellectual property.
8. Acceptable use
You agree not to:
- • Use our products for any unlawful purpose
- • Attempt to reverse-engineer, decompile, or extract source code from our products (except where permitted by applicable law)
- • Redistribute, resell, or sublicense our products without authorization
- • Interfere with or disrupt our services or infrastructure
9. Limitation of liability
To the maximum extent permitted by law, Position5 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the applicable product in the 12 months preceding the claim.
10. Disclaimer of warranties
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our products will be error-free, uninterrupted, or compatible with all systems or configurations.
11. Changes to these terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our Services after changes constitutes acceptance of the updated Terms.
